Terms & Conditions

These Terms and Conditions apply to products sold by Armour Remediation Technologies LLC. Additional or different terms may be included in a written quotation, purchase order, contract, or other agreement accepted by Armour Remediation Technologies LLC. In the event of a conflict, the terms of the accepted written agreement will control.

 

 

QUOTATIONS AND ORDER ACCEPTANCE

Product availability, pricing, quantity, production schedule, delivery timing, shipping arrangements, and payment terms will be confirmed for each order.

 

All quotations are subject to the terms stated in the quotation and remain valid only for the period specified. Prices published on this website are subject to change and must be confirmed when an order is placed.

 

A customer request, website communication, quotation, or submitted purchase order does not constitute an accepted order until Armour Remediation Technologies LLC confirms acceptance in writing or otherwise executes the applicable contract.

 

Armour Remediation Technologies LLC reserves the right to decline an order or propose revised terms based on product availability, quantity, production requirements, delivery schedule, destination, regulatory requirements, or other order-specific considerations.

 

 

PAYMENT

Payment terms are established for each order and may vary based on order quantity, production requirements, delivery schedule, customer credit, and the applicable quotation, purchase order, or contract.

 

Large-volume, custom-production, or specially scheduled orders may require an initial production commitment, milestone payments, or other mutually agreed payment arrangements before production or shipment. Any such requirements will be identified in the quotation or other order documentation before the order is accepted.

 

For government purchases, when applicable, payment and any permissible financing terms will be coordinated with the contracting officer (or equivalent) and governed by the applicable solicitation, purchase order, contract clauses, and federal procurement requirements.

 

Payments must be made in U.S. dollars unless otherwise agreed in writing.

 

The customer is responsible for applicable taxes, duties, fees, and similar charges unless an exemption is documented or the applicable purchase order or contract provides otherwise.

 

 

SHIPPING AND DELIVERY

Shipping method, carrier, freight terms, anticipated delivery schedule, and any applicable transportation or handling requirements will be confirmed for each order.

 

Armour Remediation Technologies LLC reserves the right to select or approve shipping arrangements appropriate for the product, order quantity, destination, safety documentation, and applicable transportation requirements.

 

Shipping, handling, insurance, accessorial charges, duties, and similar costs are additional unless expressly included in the quotation, purchase order, or contract. Freight may be prepaid and added to the invoice, billed to the customer’s carrier account, shipped freight collect, or handled through another mutually agreed arrangement.

 

Quoted shipment and delivery dates are estimates unless expressly guaranteed in writing. Armour Remediation Technologies LLC will make commercially reasonable efforts to meet confirmed schedules but is not responsible for delays caused by carriers, material availability, regulatory requirements, production delays, events beyond its reasonable control, or changes requested by the customer.

 

The customer is responsible for providing complete delivery information and for ensuring that the delivery location can safely and lawfully receive, unload, store, and handle the product.

 

 

ORDER CHANGES AND CANCELLATIONS

Requests to change or cancel an accepted order must be submitted promptly and are subject to written approval by Armour Remediation Technologies LLC.

 

The customer may be responsible for costs already incurred or committed in connection with production, materials, packaging, shipping, cancellation, or other order-specific requirements. Any applicable cancellation terms will be addressed in the quotation, purchase order, contract, or written order confirmation.

 

 

INSPECTION, CLAIMS, AND RETURNS

Customers should inspect shipments promptly upon receipt and notify Armour Remediation Technologies LLC of any visible damage, shortage, shipping discrepancy, or alleged order error.

 

No product may be returned without prior written authorization and shipping instructions from Armour Remediation Technologies LLC. Unauthorized returns may be refused.

 

Claims concerning product condition, quantity, shipment, or fulfillment must be submitted in writing within 60 days after shipment unless a different period is stated in the applicable purchase order or contract.

 

Products produced, packaged, or scheduled for a particular order may be nonreturnable except in the event of a verified product defect or fulfillment error attributable to Armour Remediation Technologies LLC.

 

 

PRODUCT QUALITY AND LIMITED WARRANTY

Armour Remediation Technologies LLC warrants that, at the time of shipment, its products will materially conform to the applicable product specifications or other written requirements accepted for the order.

 

Except for the express warranty stated above, and to the extent permitted by applicable law, Armour Remediation Technologies LLC makes no other express or implied warranty, including any implied warranty of fitness for a particular purpose.

 

Product performance may depend on site conditions, application methods, dosage, preparation, storage, handling, environmental conditions, contaminants, substrate characteristics, and other factors outside the control of Armour Remediation Technologies LLC. Customers are responsible for determining whether a product and proposed application are suitable for their intended use.

 

Any technical information, recommendations, test results, or application guidance supplied by Armour Remediation Technologies LLC are provided in good faith based on available information. They do not replace site-specific evaluation, professional judgment, regulatory review, or compliance with applicable requirements.

 

 

PRODUCT USE AND COMPLIANCE

Products are manufactured in the United States and are supplied for professional, commercial, research, field-evaluation, and other approved applications.

 

Products are not intended for use as food, drugs, medical products, or for direct human-use applications.

 

Customers are responsible for reviewing applicable product information and safety documentation and for complying with all laws, regulations, permits, approvals, workplace-safety requirements, environmental requirements, and accepted handling practices applicable to their purchase, storage, transportation, testing, and use of the product.

 

The identification or sale of a product does not grant a license to use it in a manner that infringes any patent or other intellectual-property right.

 

 

LIMITATION OF LIABILITY

To the extent permitted by applicable law, Armour Remediation Technologies LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages, including lost profits, loss of use, business interruption, or costs arising from improper storage, handling, application, or use.

 

Any liability of Armour Remediation Technologies LLC arising from a product or order will not exceed the amount paid for the product giving rise to the claim, except where a different limitation is required by applicable law or expressly agreed in a written government contract or other executed agreement.

 

 

GOVERNMENT ORDERS

For purchases by the United States Government, these Terms and Conditions are intended to supplement, and not replace, the applicable solicitation, purchase order, contract, or mandatory federal clauses.

 

Nothing on this website is intended to require a federal agency to accept payment, financing, warranty, indemnification, dispute-resolution, governing-law, or other terms that are inconsistent with applicable federal procurement law.

 

Order-specific requirements will be addressed with the authorized contracting or procurement representative before order acceptance.
